Capitalized terms used in these terms and conditions have the following meaning:
(a) Product: the product that You entrusted to Us for an intervention as defined in the Service Request;
(b) Service Request: the service request stipulated in the repair request slip given to the Client or in the confirmation email sent by Hermès to the Client;
(c) Terms and Conditions: these terms and conditions relating to after-sales services and applicable to the interventions We carry out on your Product;
(d) Hermes/We/Our: HERMES JAPON CO., LTD., registered office at 4-1, Ginza 5-Chome, Chuo-Ku, Tokyo, 104-0061, Japan;
(e) The Client/the Customer/You: Hermès' client requesting Hermès to provide the services described below in accordance with the Service Request and with the Terms and Conditions.
You warrant and represent that You are acting as an end consumer and not as, or on behalf of, a professional, reseller or reseller’s agent. The foregoing representation is an essential condition to Hermes’ acceptance of Your Product for Service.
The signature of the Service Request and/or your validation of the quotation mentioned in article 6 (Rates and Payment) cannot be considered as an obligation for us to repair Your Product.
The services offered by Hermès under these Terms and Conditions are exclusively (hereinafter the "Services"):
(a) Product’s repair and maintenance,
(b) Hermès Ready-to-Wear Repair and Alteration Services,
(c) Customization services: in the event of a Product’s personalization at the Customer's request, the Product cannot be exchanged or returned to Hermès.
For each Service Request, We will assign a reference number that We will provide You with at the time of Our confirmation (by email) of the Service Request. Please quote this reference number in all subsequent correspondence regarding your Service Request.
If We are unable to repair your Product or perform certain Services (in particular due to the condition of the Product), We will inform You and We will not proceed with the intervention request, even if the estimate has been validated by You. In any event, You acknowledge that Hermès is subject only to an obligation of means and not of results in relation to the Services. No compensation will be due by Hermès to You if You are not fully satisfied with the Service.
Please note the following points regarding services offered by Hermes:
(a) An intervention on a used Hermès Product, does not render it new.
(b) We refuse any request of change of the design of our product to protect the design.
(c) We reserve the right to choose the most suitable place to carry out Service Requests on Your Product (including France or Switzerland).
(d) We may refuse the repair of Product which were repaired by repairers non-authorized officially by HERMES, including customers themselves.
(e) As a general rule, the replaced or ground spare-parts or metal parts will be collected by us and not returned.
(f) We may use the similar spare-parts, when the identical one is not available. The requested repair may not be possible, due to the finish of the supply of spare parts, or other reasons.
(g) Care of the leather may not give change in outward appearance, according to the status of Product. The hidden stain or mark may become more visible as a result of care.
(h) With a hygienic reason, we may reject the repair.
(i) Product will be photographed to check and record the condition.
THESE TERMS AND CONDITIONS, ANY REPAIR REQUEST SLIPS, QUOTATIONS OR AFTER-SALES INVOICES DO NOT CONSTITUTE IN ANY FORM WHATSOEVER AN AUTHENTICATION OF YOUR PRODUCT, NOR CAN THEY BE USED AS CERTIFICATION OR PROOF OF AUTHENTICATION OF SAID PRODUCT, OR FOR ANY RELATED PURPOSES. IN ADDITION, AN AFTER SALES INVOICE DOES NOT CONSTITUTE PROOF OF PURCHASE OF YOUR PRODUCT.
As stated in the Service Request, You acknowledge that You have been informed that the time taken to complete the Service(s) may vary depending on the intervention performed on your Product. An approximate date of return will be communicated to You. This period may be extended if necessary by Hermès to carry out the Service(s). We will inform You as soon as your Product is ready to be returned. You may pick it up from Our premises, during the opening hours of the Hermès boutique in which You signed the Service Request.
Your Product will be under your responsibility as soon as We have returned it to You.
Product is returned in exchange with the repair request slip. When you wish to pick up the item, please bring repair request slip or present the email screen receiving repairs. We will view the person who has a repair request slip or email screen as a customer and hand over Product, so please be careful when handling with the repair request slip and email screen.
If you have not the repair request slip or the email screen, the presentation of the driver’s license, my number card, residence card, passport, or other official photo ID is required.
PLEASE PICK UP PRODUCT AS SOON AS POSSIBLE AFTER CONTACTING YOU THAT THE REPAIR HAS BEEN COMPLETED. YOU HAVE TWO (2) YEARS, FROM THE DATE ON WHICH YOU WERE INFORMED THAT YOUR PRODUCT WAS READY TO BE RETURNED TO YOU, TO PICK UP YOUR PRODUCT. WE WILL SEND YOU A WRITTEN REMINDER, BY REGULAR MAIL AND/OR E-MAIL AROUND THE END OF THE TWO (2) YEAR TERM MENTIONED ABOVE. THEREFORE, WE INVITE YOU TO KEEP US INFORMED OF ANY CHANGE IN YOUR CONTACT DETAILS THAT MAY OCCUR AFTER THE DEPOSIT OF YOUR PRODUCT. IF, DESPITE THE SENDING OF THIS REMINDER LETTER, YOU HAVE NOT PICKED UPYOUR PRODUCT WITHIN THIS TWO (2) YEAR TERM OR WE CANNOT CONTACT YOU, YOU ACKNOWLEDGE AND ACCEPT THAT YOUR PRODUCT WILL BE CONSIDERED AS ABANDONED, WITH THE POSSIBILITY FOR US TO DISPOSE OF IT IN OUR SOLE AND ABSOLUTE DISCRETION, YOU WILL NOT BE ENTILTED TO ANY REFUND, LIABILITY AND/OR COMPENSATION OF ANY KIND AND IN ANY MANNER WHATSOEVE
BY ACCEPTING THESE TERMS AND CONDITIONS AND SUBMITTING YOUR PRODUCT TO US, YOU DECLARETHAT, TO THE BEST OF YOUR KNOWLEDGE, THE PRODUCT ENTRUSTED TO US IS AN AUTHENTIC HERMÈS PRODUCT. IF IN THE CONTEXT OF THE SERVICES THAT HERMES’ PROVIDES, IT IS NOTED THAT YOUR PRODUCT IS NOT AUTHENTIC, WE WILL INFORM YOU IN WRITING SPECIFYING THE ELEMENTS LEADING US TO CONCLUDE THAT YOUR PRODUCT IS NOT AUTHENTIC. IN ACCORDANCE WITH THE PROVISIONS OF THE APPLICABLE INTELLECTUAL PROPERTY CODE, THIS PRODUCT SHALL NOT BE REPAIRED, SHIPPED OR STORED BY OUR SERVICES, WHICH YOU ACKNOWLEDGE AND ACCEPT. IT WILL THUS BE DESTROYED AND/OR TRANSFORMED AND/OR RECYCLED BY US UNLESS YOU JUSTIFY IN WRITING, WITHIN THREE (3) MONTHS FOLLOWING OUR CERTIFICATE’S ISSUANCE DATE, THE NEED TO RECOVER YOUR PRODUCT IN ORDER TO TAKE LEGAL ACTION AGAINST THE PERSON WHO SOLD IT TO YOU. YOUR PRODUCT CAN ONLY BE RETURNED TO THE HERMES BOUTIQUE LOCATED AT 24 RUE DU FAUBOURG SAINT-HONORE IN PARIS (FRANCE), BY APPOINTMENT. THE APPOINTMENT MUST BE MADE BY YOU WITHIN THREE (3) MONTHS FOLLOWING YOUR RETURN REQUEST. FOR WATCHES, YOU MAY PICK UP YOUR PRODUCT AT LA MONTRE HERMÈS LOCATED AT ERLENSTRASSE 31A, 2555 BRUEGG (SWITZERLAND).
YOU ACKNOWLEDGE AND AGREE THAT THE DESTRUCTION OR TRANSFORMATION OF YOUR NON-AUTHENTIC PRODUCT UNDER THE ABOVE CONDITIONS WILL NOT ENTITLE YOU TO ANY REFUND OR COMPENSATION OF ANY KIND AND IN ANY MANNER WHATSOEVER.
The indicated repair price is approximate. The final repair price will be determined after technical examination of repairer. If the final repair price exceeds the indicated repair price or the accepted amount, you will be contacted before the repair is started. Estimate is valid for 3 months. If the period exceeds, re-estimation may be required.
Depending on the repair, it may be found that the repair cannot be accepted, or the repair price may be changed after the final repair price is decided. In that case, we will contact you when it becomes clear.
In accordance with the "after-sales service warranty certificate" for Hermès watches, provided after repair has been carried out on your Hermès watch (hereinafter the "Watch"), all repairs carried out on Your Watch, as well as all replaced parts, are guaranteed for a period of twenty-four (24) months from the date indicated on the said Certificate (hereinafter the "Warranty"). The Warranty applies only to the repaired parts of your Product and repairs made by us.
The damage and/or defects alleged under the Warranty must be identified and confirmed by Our services or an official repair center or a repair center approved by Hermès. The Warranty does not apply to normal wear and tear or any damage resulting from accident, negligence or improper handling as well as, more generally, in the event of obvious signs of misuse or abuse. A repair that has not been carried out by an official repair center nor a repair center approved by Hermès is not covered by the Warranty and will render both the Warranty and Hermès' international guarantee null and void.
The provisions of this article apply only to repair services and do not exclude, limit or modify the rights You have under the legal guarantees provided by applicable law.
Under no circumstances shall Hermès be held liable for any damage that is not the direct result of a breach by Hermès of one of its obligations, except in cases of willfulness or gross negligence.
In the event of total or permanent loss or damage of the Product while it is in our possession, We will replace it identically with an new item or, with your consent, an item of like kind. If the replacement with an identical or equivalent item is not possible, You will receive compensation equal to the retail purchase price of the Product, based on the country where it was purchased, or of an equivalent item on the date of the loss or damage occurred. This amount will be determined objectively and justified based on all supporting evidence (purchase invoice, etc.). Such compensation shall not exceed the retail price of an item of the same type and equivalent quality, unless We expressly agreed otherwise in writing. This clause does not preclude the application of legal guarantees or the customer’s rights under the legal guarantee of conformity and or the guarantee against hidden defects.
The Terms and Conditions shall be governed by and interpreted in accordance with Japanese law. Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the Tokyo courts. However, as a consumer, you will benefit from any mandatory provisions of the law of the country in which you are legally resident. Nothing in these Terms and Conditions shall deprive you of the mandatory rights you may have as a consumer under the laws applicable in your country of residence.
