Sales of Hermès products (including “petit h” products), Puiforcat and Saint-Louis products (together, the “Product(s)”), by Hermes Asia Pacific Limited (“Hermès”) to end customers (the “Customer(s)”, “you”) at Hermès stores are subject to these General Terms and Conditions of Sale (the “General Terms and Conditions”). The General Terms and Conditions do not apply to products subject to specific terms and conditions of sale, such as special orders, orders for furniture, wallpaper, upholstery fabrics and carpets. These specific terms and conditions are available in Hermès stores.
愛馬仕亞太區有限公司(「愛馬仕 」)通過愛馬仕專門店向終端客戶(「客戶 」、「您 」)銷售愛馬仕產品(包括「petit h 」產品)、Puiforcat及Saint-Louis產品(統稱「產品 」)均受本一般銷售條款及細則(「本條款 」)所規限。本條款不適用於受特定銷售條款及細則所規限的產品,如特殊訂單、傢俱、牆紙、裝飾面料及地毯訂單。該特定條款及細則可在愛馬仕專門店查閱。
The Products are exclusively intended to be sold to end consumers, for personal use and not for commercial purposes.

In order to ensure a better quality of service and availability of our Products for all Customers, we reserve the right to limit the quantity of Products you can purchase.

The sale price of the Products is inclusive of all taxes and does not include any delivery costs, unless otherwise indicated. The sale price of the Products is that in force on the date of sale and includes their packaging. Products invoiced are payable outright. In case of product order, a deposit corresponding to a percentage of its sale price, which varies according to the type of Product and the Hermès store concerned, may be requested and will be invoiced as a deposit. The balance must be paid when the Product is delivered to the store or before delivery. Gift cards and credit notes cannot be used to purchase a Kelly or Birkin bag. The terms and conditions applicable to the use of gift cards and credit notes are available in Hermès stores. The Products will be collected from Hermès stores by you. Provided that the delivery organised by Hermès is possible, delivery of the Product will generate additional transport, customs and insurance costs payable by you, which will be communicated to you prior to the sale. If you wish to return a Product that has been delivered to you, you will be responsible for the return costs. Hermès will not deliver any Product to a P.O. Box or to a forwarding company. The purchase of a Product subject to quota involves verification of the Customer's identity. Where a personalisation service is available, Hermès cannot be held responsible for the personalisation requested: such requests must not infringe the rights of third parties, be contrary to public order, morality or the law in force, or be incompatible with the image of Hermès. In such cases, Hermès reserves the right to refuse your request for personalisation.

3.1. Products purchased in Hong Kong
於香港購買的產品
Products purchased at a Hermès store located in Hong Kong may be exchanged and/or be the subject of a credit note, within thirty (30) days of purchase, subject to compliance with the terms and conditions below. Only new, unaltered, unworn or unused Products (sealed for perfumes and cosmetics, if applicable, with their plastic protection for swimwear, for reasons of hygiene), in their original, unopened packaging (including the orange box and original labels still attached) may be returned, upon presentation of proof of purchase and the warranty certificate for watches, and the precious stones and metals certificate for the jewellery and watches concerned, issued by the Hermès store where the sale took place. In addition, Products sold with a traceability document (CITES, P Permit or Exemption) must be returned with this document, and Products subject to a tax refund must be returned with the tax refund slip. Hermès will not be able to reissue a lost CITES document under any circumstances. “petit h” Products may only be exchanged and/or be the subject of a credit note, in the event of a one-off sale, at the Hermès store where they were purchased for the duration of the temporary sale. The value taken into account when issuing a credit note or exchanging your Product is the sale price including tax of the Product stated on the proof of purchase issued by the Hermès store where the sale took place. The following Products are excluded from the right of return to a Hermès store: watches, jewellery, bespoke and/or personalised Products, and Products purchased during exceptional sales (which are marked).
在香港的愛馬仕專門店購買的產品可於購買的三十(30)日內換貨及/或換取代金券,但須符合以下條件及細則。此外,退貨只適用於全新、未經改動、未穿著或未使用過的產品(香水及化妝品須保持密封狀態(如適用),泳裝因衛生原因需保留塑膠保護膜),且原包裝完整未拆(包括橙色包裝盒及未拆卸的原標籤),並需出示由銷售產品的愛馬仕專門店所出具的購買憑證及, 如涉及手錶須同時提供保證證書, 如涉及珠寶及手錶貴金屬寶石部件,須提供相關保證證書。另外,附帶可追溯文件(如CITES、P許可證或豁免證明)的產品須連同本文件退貨,及享受退稅的產品退回時須附退稅單。愛馬仕在任何情況下不能補發遺失的CITES文件。若您在一次性銷售的情況下購買 「petit h 」 產品, 您只可以在其臨時銷售期間於原購買的愛馬仕專門店換貨及/或換取代金券。在開具代金券或進行換貨時,所依據的金額為由銷售產品的愛馬仕專門店所出具的購買憑證上所列的該產品銷售價格(含稅)為准。以下產品不適用於在愛馬仕專門店的退貨權限:手錶,珠寶,定制及/或已個人化的產品,以及於獨特促銷期間購買的產品(已標識)。
3.1.1 Exchange

You may exchange your Product purchased in Hong Kong, at a Hermès store:

- Located in Hong Kong , if the value of the Product(s) chosen as a replacement is greater than the value of the Product(s) returned, you will be required to pay the price difference; if the value of the Product(s) chosen as a replacement is lower than the value of the Product(s) returned, a credit note will be issued;
位於香港的愛馬仕專門店換貨,如被選爲替換品的產品價值高於被換貨的產品,您將被要求支付差價;如被選爲替換品的產品價值低於被換貨的產品,則開具代金券。 - Located in another country, subject to the application of local regulations (particularly tax regulations) and excluding Products subject to CITES regulations. It should be noted that no credit note can then be issued. Exchange is not possible in the following geographical areas: Argentina, Brazil, Mainland China, India, Lebanon, Vietnam, Russia, South Korea, Taiwan, Thailand and at airport stores in all areas combined.

Your Product may be exchanged for an item from the “bags, luggage and small leather goods” category in Hong Kong or abroad, provided that the Product being returned belongs to this category. You can only receive a Kelly or Birkin bag in exchange for a Kelly or Birkin bag. Each item can be returned or exchanged only once. Exchanged products cannot be exchanged again.
退回的產品若屬 「包、旅行箱包及小皮具 」類別,可在香港或海外換同類別產品。您只可以將Kelly或Birkin包換Kelly或Birkin包。每件產品僅可退換一次,已換貨產品不可再次換貨。
3.1.2 Issue of a credit note
開具代金券
In the absence of an exchange and subject to the return of your Product under the conditions set out above, you may receive a non-refundable credit note at any Hermès store located in Hong Kong, which may be used at any Hermès store located in Hong Kong within one (1) year from the date of issue. A credit note cannot be issued or accepted in an airport store.
若未換貨且在產品的退貨符合上述條件的前提下,您可在任何位於香港的愛馬仕專門店獲得不可退款的代金券,該代金券可自開具日起一 (1) 年内在任何位於香港的愛馬仕專門店使用。但,機場專門店不可開具或接受代金券。
Credit notes may be used to purchase a Product in the “bags, luggage and small leather goods” category provided that the Product to which the credit note relates belongs to this category. Credit notes cannot be used to purchase a Kelly or Birkin bag, except if the Product giving rise to the credit note is a Kelly or Birkin bag.

3.2. Products purchased outside Hong Kong or in airport stores in Hong Kong

Without prejudice to Article 3.1, your Product purchased outside Hong Kong or in airport stores in Hong Kong may be exchanged for any other item not belonging to the “bags, luggage and small leather goods” category, unless the Product to which the return relates belongs to this category. You can only receive a Kelly or Birkin bag in exchange for a Kelly or Birkin bag. No credit note can be issued. For more information, please consult the terms and conditions of sale of the Hermès store where the sale took place.

When a quotation is drawn up by Hermès, it constitutes an offer that may include special terms and conditions that amend or supplement these General Terms and Conditions. Orders placed by the Customer must be accepted in writing by Hermès in order to be considered final. Once accepted, the order form constitutes the special terms and conditions amending or supplementing the General Terms and Conditions.

- Legal warranty of conformity (Sale of Goods Ordinance of Hong Kong):

Hermès will deliver to you a Product that complies with the contract and is free from non-conformities at the time of delivery of the said Product, in the sense that the Product will be fit for the use usually expected of a similar good and will have the characteristics presented at the time of sale. Hermès will also be liable for any non-conformities resulting from the packaging, assembly instructions and/or installation, provided that the installation was the responsibility of Hermès under the contract or was carried out under its responsibility. Non-conformities that appear within twenty-four (24) months of delivery of the Product are presumed to have existed at the time of delivery, unless proven otherwise. To benefit from this warranty, you must apply for it within twenty-four (24) months of delivery of the goods. If the conditions are met, you will have the choice between repair or replacement of the Product, unless one of these choices results in a manifestly disproportionate cost for Hermès. If these choices are impossible, you may obtain a refund of (i) the full price paid provided that the Product is returned, unless the non-conformity is minor, or (ii) part of the price paid and keep the Product.
愛馬仕將向您交付的產品須符合合同約定且在產品交付之時並無不合規之處,即產品將適合類似產品通常預期的用途且具備銷售時所呈現的特徵。愛馬仕亦將對於因包裝、組裝說明及/或安裝而導致的任何不合規之處承擔法律責任,前提是安裝為愛馬仕合約規定的責任或在其責任下進行。除非另有證明,否則產品交付後二十四(24)個月內出現的不合規之處視為交付時已存在。如欲從本保證受益,您須在產品交付後二十四(24)個月內申請保證。如符合條件,您將可選擇維修或更換產品,除非其中一個選擇對愛馬仕造成明顯不成比例的成本。若以上選擇為不可能,您可獲(i)全額退款(前提為產品被退回),除非不合規之處為輕微,或(ii)部分退款並保留產品。
- Legal warranty against hidden defects (Sale of Goods Ordinance and Control of Exemption Clauses Ordinance of Hong Kong):
對隱蔽缺點的法定保證 (香港《貨物售賣條例》及《管制免責條款條例》)
Hermès will deliver to you a Product free of hidden defects that would render it unfit for its intended use, or that would impair that use to such an extent that you would not have purchased it, or would only have paid a lower price for, had you been aware of them. To benefit from this warranty, you must apply for it within twenty-four (24) months of the discovery of the defect and prove that the terms and conditions of the warranty have been met. In the event of a hidden defect, you will have the choice between refund of (i) the full price paid provided that the Product is returned or (ii) part of the price paid and keeping the Product.
愛馬仕將向您交付不存隱蔽缺點的產品,所指的隱蔽缺點為會導致產品不適合其預定用途、或會損害該用途至一個您若得知隱蔽缺點不會購買或只願意支付較低價格的程度的隱蔽缺點。如欲從本保證受益,您須在發現缺點後二十四(24)個月內申請,並證明符合保證的條款及細則。如有隱蔽缺點,您將可選擇(i)全額退款(前提為產品被退回),或(ii)部分退款並保留產品。
- Application of these legal warranties shall be free of charge and does not preclude the possible award of damages should you be entitled to them.

Any Product that can be technically repaired will benefit from an after-sales service. The terms and conditions applicable to the Hermès after-sales service are available at Hermès stores and will be provided to you prior to the provision of the after-sales service. Hermès hereby informs you that no period of availability of spare parts essential to the use of the Products is guaranteed.

Ownership of the Products sold will be transferred to you upon effective payment of the full price, including associated costs (delivery, installation, etc.). The risks of loss, theft and/or deterioration of the Product, as well as any damage it may cause, will be transferred to you as soon as you take possession of the Product directly or indirectly through a third party designated by you.

The General Terms and Conditions do not confer any right whatsoever over the intellectual property rights belonging to companies in the Hermès Group, including over creations related to the Products of which Hermès remains the owner. Therefore, you shall refrain from manufacturing and/or having manufactured, on your behalf and/or on behalf of third parties, products that are identical and/or similar and/or that may constitute imitations of the Products within the meaning of the Trade Marks Ordinance (Cap. 559), Trade Descriptions Ordinance (Cap. 362), Copyright Ordinance (Cap. 528), and/ or other intellectual property laws, as well as derivative products. You are also prohibited from affixing the Hermès brand and/or logo and/or inserting photos of the Products or their packaging on any medium whatsoever (prospectus, poster, catalogue, letter, press article, audiovisual production, website, intranet site, social networks, etc.) without the prior written consent of Hermès, unless the photos of the Products or their packaging are solely for the Customer’s personal use.

Under no circumstances shall Hermès be held liable for any damage not resulting from a breach by Hermès of one of its obligations, including applicable legal or regulatory provisions of public order.

The General Terms and Conditions shall be governed by and interpreted in accordance with Hong Kong laws. The General Terms and Conditions do not prevent the application of a provision that is more favourable to you, under the law of the country in which you reside and from which there can be no derogation by agreement. In the event of a dispute relating to the application and/or interpretation of the General Terms and Conditions, you may have recourse to mediation by having the dispute or difference arising out of or in connection with the General Terms and Conditions referred to mediation at Hong Kong International Arbitration Centre (HKIAC) and in accordance with its then current Mediation Rules, after first approaching Hermès in writing and failing to reach a settlement. To submit a dispute to mediation, you can complete and submit a request to the HKIAC (see www.hkiac.org ), you may also bring an action before the court of Hong Kong, and Hermès may also bring an action before the court of Hong Kong.
本條款應受香港法律管轄並按其詮釋。本條款不妨礙 根據您所居住的國家法律適用對您更有利的條款,且該條款不得透過協議減損。如有爭議關於本條款的適用及/或詮釋,您應首先以書面形式聯繫愛馬仕,若未能達成和解,您可透過將由本條款產生或與本條款相關的爭議或分歧提交至香港國際仲裁中心 (HKIAC)調解並根據其當時適用的調解規則以調解解決。如需將爭議提交調解, 您可以填寫並提交申請至HKIAC (請參閱 www.hkiac.org )。您也可向香港法院提起訴訟,愛馬仕也可向香港法院提起訴訟。
